The $200 VISA GiftCard Giveaway (the “Giveaway”)

DMB Financial, LLC’s decisions regarding the Giveaway are final and non-appealable. All submissions are subject to the terms of these Official Rules & Regulations and all entrants agree to be bound by these rules and DMB Financial, LLC 's decisions. DMB Financial, LLC reserves the right in its sole discretion to amend these rules at any time and DMB Financial, LLC will post the revised rules and/or notice of any such rule changes on www.dmbfinancial.com/visasweepstakesrules.asp. The rules in effect at the conclusion of the Entry Period will apply regardless of submission date. If DMB Financial, LLC is unable to complete the Giveaway due to the forces beyond DMB Financial, LLC’s control, DMB Financial, LLC reserves the right not to award all prizes set forth below. Please see section(s) 5 and 13 of these rules regarding additional rules for awarding of prizes.

1. ELIGIBILITY: NO PURCASE NECESSARY. ENROLLMENT IN A DMB FINANCIAL, LLC DEBT SETTLEMENT PROGRAM WILL NOT INCREASE YOUR CHANCES OF WINNING. To be eligible for this offer, you must fully complete a NO OBLIGATION, Budget Analysis (also referred to as a "Free Budget Analysis") providing all requested information and agree to the terms herein. Each entrant must be a resident of the United States, must be 18 years of age or over at the time of entry. Limit one entry per household during the Entry Period. This giveaway does not discriminate against anyone based on race, age, sex, handicap, religion, national origin or marital status. Entrants are not eligible if they are employees of DMB Financial, LLC, their advertising/promotion agencies, agents or a member of any such employee’s immediate family (mother, father, brother’s sisters, sons, daughters, spouse or children of a spouse) or person with whom you are domiciled (whether related to the employee or not). Residents of Arizona and Rhode Island are not eligible for this offer.
2. SPONSOR: This giveaway is sponsored by DMB Financial, LLC.
3. ENTRY PERIOD: This giveaway runs from 12:01am (EST) on August 1, 2009 to 11:59pm (EST) on November 2, 2009. Entries received prior to or after the Entry Period will be disqualified. Entries are subject to verification. Entries that are late (including delayed data transmissions), misdirected, incomplete, lost, destroyed, falsified or otherwise not in compliance with these Official Rules & Regulations will be disqualified at sole discretion of Sponsor.
4. TO ENTER: Persons wishing to enter must call (888) 289-8315 and speak with a DMB Financial, LLC Debt Settlement Program Consultant. Each entrant must fully complete every question contained in the NO OBLIGATION, Budget Analysis providing all requested information by the Debt Settlement Program Consultant. The entire personal Budget Analysis must be completed during the Entry Period. Failure, by the entrant, to provide all information to complete the Budget Analysis, including non-public personal information, will render entrants submission null and void. Entries received by fax, mail, email, courier, or personal or other form of delivery will not be accepted
5. GRAND PRIZE: Winner shall receive one (1) $200 VISA GiftCard. The estimated value of this prize is $200.00. The Grand Prize must be accepted as awarded without substitution and is not transferable. Certain restrictions may apply, and winner is responsible for any applicable sales and luxury taxes. Grand Prize details subject to change, and if changed a prize of equal or greater value will be substituted at Sponsor’s sole discretion. Grand Prize is non-transferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor.
6. DELIVERY: DMB Financial, LLC will deliver the Grand Prize to the address contained on the winning Budget Analysis within thirty (30) days of being declared a winner.
7. DRAWING: On or about November 6, 2009 at approximately 10:00am (ET) in Beverly, Massachusetts, the Sponsor will select one (1) Grand Prize winner in a Random Drawing from among all eligible entries received during the Entry Period. Odds of winning are determined by the total number of eligible entries received during the Entry Period. Sponsor’s decisions are final. Entrants need not be present to win. The selected entrant will be contacted by mail, email or telephone within ten (10) business days of the draw date. If the selected entrant cannot be contacted within ten (10) days, he/she will be disqualified and a new random drawing from the remaining eligible entries will be conducted to select another Grand Prize winner and the process noted above will be repeated until a winner is declared.
8. PUBLICITY: By entering this giveaway, the winner authorizes DMB Financial, LLC and their representatives to use in any related publicity, if required, their name, likeness, photograph, image, any statements they may make regarding the prize, biographical information, or place of residence and/or voice for advertising purposes world wide in perpetuity and in any form of media including the Internet, without any further payment or compensation.
9. RELEASE: The Grand Prize winner is required to sign a Declaration and Release Form confirming compliance with these Official Rules, acceptance of the Grand Prize as awarded, without substitution, and releasing DMB Financial, LLC, its owners, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively, the “Released Parties”) from any liability in connection with the Grand Prize or this giveaway.
10. LIMITATION OF LIABILITY: The Released Parties may not be held liable for (i) late, lost, delayed, misdirected, incomplete, fraudulent or otherwise invalid entries, including ineligible entries as a result of human error (all of which entries shall be automatically void and not eligible for a prize); or (ii) failure to receive entries due to transmission failures, or technical failures of any kind, regardless of whether originating with DMB Financial, LLC.
11. GENERAL: By entering the giveaway, entrants agree to abide by the Official Rules and the decisions of DMB Financial, LLC with respect to all aspects of the giveaway, which are final.
12. This offer is prohibited where taxed, restricted or where the Sponsor does not maintain the required licenses or registrations to make such offer.
13. DMB Financial, LLC reserves the right, without prior notice and without liability, to void any entry and/or cancel, suspend or modify the giveaway in whole or in part (without notice to entrant’s individually) if, in its sole discretion, it determines that for any reason (such as tampering or infection by computer virus or any other cause beyond its control) the giveaway is not capable of being conducted as intended, fraud, technical failures, human, printing or distribution errors, or any other causes or occurrences have compromised the administration, safety, fairness or integrity of the of the giveaway. Any person entering this giveaway or trying to do so by any means which go against the intention of these Official Rules and which would be unfair to the other participants will be automatically disqualified and DMB Financial, LLC reserves the right to seek remedies and damages to the fullest extent permitted by law-including criminal prosecution.
14. All entries become the permanent property of DMB Financial, LLC and none will be returned. No correspondence will be entered into except with the selected entrant. This giveaway is subject to all federal, state and municipal laws and is void where prohibited by law.
15. As part of this giveaway, you may be contacted by the Sponsor. By applying for the benefits of this giveaway, you expressly request and agree that the sponsor and their marketing partners may contact you by telephone, mail, or e-mail for the purpose of promoting various products and/or services including debt settlement services.
16. You expressly waive all United States federal and state No-Call Registry protections for the purpose of future marketing.
17. By providing your information and seeking the benefits of this giveaway, you are becoming a customer of the Sponsor and are establishing a business relationship with it.
